    Debt Collection Practices

Goodness. When we say date of last activity, that means basically, when is the last time you made a payment before the account went delinquent? For instance, if it's a credit card and it's charged off, when was the last payment before it charged off? I've not heard of this law firm. Maybe...

    Debt Collection Practices

What's the name of this firm? How old is the debt? 1) Stop calling them unless you have a tape recorder rolling. 2) Send them another letter stating since there is so much debatable info there, now you not only do you want the amount, you want to see itemized statements explaining HOW they got...

    debt collectin

I disagree. I would put a stop payment on the checks and, just to be safe, switch banks. They've been known to root around to find out if you've switched acct numbers. This agency is full of it - even if they DID try and sue you, you can answer their summons with the affirmative defense...

In-House collections department considered a debt collector?

*Yawn* Ignore that yammering. Unfortunately, unless they're using a different name...they are still considered the creditor and don't have to abide by FDCPA.

    SOL up on old debt

Personally, I would write them again and say something like "I sent your company a request to cease communication on [DATE], which was received and signed for on [DATE]. Your company refuses to comply with such request and has contacted me on these dates/times: [date1], [date2], [date3], and...

In-House collections department considered a debt collector?

As you said, "debt collector", according to FDCPA statutes, means anyone who '...attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another.' This would normally only be outside parties. HOWEVER...it goes on to say "...the term includes any creditor...

Am I Personally Liable for this Business Debt?

I think that might all depend on what the user agreement says. Do you have a copy of it? It might state in there "if I sign this, I will be responsible", in which case, you signed it...and would be responsible. Signing your personal name to business debts is sometimes tricky. If you put a...

    Civil Summons

I highly doubt that's true for a debt-related summons. If you fail to show up to court for a criminal matter or even a traffic matter, they may issue the warrant. There is no debtor's prison anymore...they can't take you to jail for not paying a debt. They CAN issue a judgment against you...

Who is just trying to scare me?

You mean they have NEVER sent you anything in the mail? Are you sure? When did they first start calling you - I'm assuming it's just a recent thing? Yes...after a first communication (that includes calling), a collection agency HAS TO, by law, send you written communication stating those...

    debt collectors

And if they start threatening otherwise, it's against the law. What does the agreement say, exactly? How much has she paid off?

    Civil Summons

And that's not necessarily true either. That's something a CA would tell ya. LOL You need to answer the summons, like Lady said. All you need to do is answer, say you don't believe the amount is correct, and then see if they can prove it. If so, you can pay them (which you already tried to...

Who is just trying to scare me?

There's not really a way to KNOW who will sue and who won't. But you can sometimes get a feel for it. The less the debt is, the less likely they will waste legal fees on it. You can also check your local court records and see how many times a certain company has sued for debts similar to...

    SOL up on old debt

Keep close tabs on who calls you and when. You can get a recording device from Radio Shack for fairly cheap that you can hook up to your phone and record. Oklahoma is a one-party state, which means you can record away without having to tell them. If you don't have a recorder, have a...
