    What is the name of your state? NY Mom and Dad want a simple heath insurance modification, both parties agree. If Mom prepares the papers can they both sign it, get it notorized and file it with the court? Or will Dad have to appear and swear before a judge?

    Possession simply means care and control. As long as Mom doesn't drink and use while being physically present caring for the child (and 12hr prior) she is not violating the order. You cannot dictate who she chooses for babysitting. You'll get no where with this one.

    You're not following the order, but technically you're not "in contempt" until a judge declares it contempt. Speak to your attorney about modifying the order.

    What exactly does your case in NJ have to do with this poster? There needs to be a change in circumstance in order for a modification to be ordered. Where's the change in circumstance? The single fact that the daughter doesn't "want" to go is not going to cut it.

    The legal age to marry without parental consent or emancipation is 18. Even if you meet the requirements for emancipation, the court process takes time. So, what's the rush?

    The child can decide for herself when she reaches the age of majority which is 18 in Oregon. Failure to comply with court orders can result in contempt charges against the violating parent.
