And, that means this lady has no money for the month of April.
Good.
This is the problem IAAL was pointing out to you regarding a POA. Just because you are a POA, that does not mean that the grantor (person you are POA for) cannot conduct his/her own affairs as he/she chooses. The grantor will...
You need a Durable Power of Attorney. Please see an estate attorney to help you draft this document. Tell the attorney exactly what you want for the agent (person named POA) to do regarding your assests to pay for your care in the event that you should become incompetent. This is a document with...
Veronica, please re-read. You'll see the following by me:
OP came back today with no further response. She's doing a good thing, but she's doing it without proper legal authorization and that can come back and "bite" her.
I don't know about CA, but here it won't cost $10,000.00 for a...
Corrine,
Have you been able to contact this lady's family? Also, have this lady call Social Security and have direct deposit stopped. When she opens an account at another bank, other than Key Bank, she can re-establish the direct deposit. This lady needs to do her banking at another bank because...
Take the trust document to an estate attorney who can read the terms of the trust and give you the legal counsel you need for this matter. I will not give the "green light" to you on this matter because I cannot read the documents. Pay for the attorney fees with the trust.
Dudley,
If your wife gives the assisted living facility her credit card number, expect about $12,000.00 per year (a good minimum figure) that your wife will be responsible to pay. Mom's POA is the one who is the legal caretaker and is responsible for paying for mom's care via mom's money and...
I just read that link and this is appalling! Unless the granddaughter has a court order granting her permission to remove the feeding tube, this is a homicide. I can only surmise that the granddaughter did not show the judge the elder's Living Will and/or the granddaughter does not know what she...
Okay. Hopefully, her sister is being co-operative. If not, the attorney will be able to assist in getting a death certificate from the funeral home or from another source with which the attorney will know about. Though Monday seems a long way away in these situations, it will be here soon. Just...
Also, have your girlfriend immediately call the bank where her mother's accounts are and inform the bank that their client is deceased so the account can be frozen so the thieves cannot remove any more of the money.
Rainier,
Check probate and trust WA statutes, especially RCW 11.88.010 and 11.88.030). Anyone can petition the court for this lady to be appointed a professional/public guardian over her estate. The fees can be waived. The court will notify the lady's family - though it would be best if you...
I agree. APS will contact this lady's family. I'm just not too sure that the average "lay person" can handle what needs to be done. This elder lady also falls for telemarketing scams who have the elder's info and has made unauthorized withdrawals from the elder's bank account.
Need some info
Have you retrieved the money in the checking account that was soley in your husband's name?
Did you and your husband purchase another home, condo, etc. prior to his passing? If so, how exactly is the property titled?
Did you have any joint bank accounts, stocks, and other...
Call Adult Professional Services immediately. This lady needs at least a professional guardian/conservator over her estate (financial affairs) who can deal with this. Also tell APS about the neighbor friend who cleaned out the lady's bank account.
Congradulations on the win. This poster has another thread that perhaps you, the other attorneys here, or seniorjudge could comment on. I don't think she liked my response because it wasn't what she wanted to hear. Here's the link https://forum.freeadvice.com/showthread.php?t=236475
Find an attorney that you can pay by the hour rather than by a percentage of the total estate. No one can tell you how much it will cost to probate this - that's why you did not obtain an answer to that question.
