The ONLY way to obtain the money from your father's bank account is to open a probate case. Start calling probate attorneys in the county where your father resided.
Agreed. I did not say anything about a spouse; all I did was give you the info on how the stuff will be split.

Trying to summarize:

I definitely need to start a probate.

Dandy Don suggested that I may have problems getting an attorney because the estate value is small (around $35k).
How can I start probate if I can't get an attorney.

I asked this question several times but I did not get an answer so far: How much (approximately) can it cost to probate?

Thanks for your help.

Find an attorney that you can pay by the hour rather than by a percentage of the total estate. No one can tell you how much it will cost to probate this - that's why you did not obtain an answer to that question.

Keep looking for an attorney. Meanwhile, do your research:

Check at the county courthouse to find out what the filing fees will be. Probate executor fees in your state are defined in the law only as "reasonable compensation", so you will need to ask the probate attorney what the legally allowable executor rate in your state is (probably less than 10%), since a Minnesota probate attorney is not likely to be reading this message board.
