14yr old wants to live with me :-)

What is the name of your state? MS

My daughter called me up and can't stand it anymore living with mom. She wants to come and live with me. Mom said she can go and I have already have reservations for a flight.

My question: Since she is of legal age to determine where she wants to live, when she arrives, how do I make this all legal to transfer her to me? Is this a lengthy process with lawyers and courts?

Any advice is much appreciated.

14 is NOT of legal age to decide where she wants to live!

I'm going on what every attorney I ever dealt with said when I was trying to get custody a few years ago. They all said the same thing (13 was legal age in Mississippi).

Maybe a better way to say it would be that the child wishes get considered by the courts at the age of 13.

13 is most likely the age at which a judge will decide whether or not to entertain the child's wishes. But there's only one state in the US that allows a child to choose which parent to live with at a certain age, and it's not Mississippi.

If you want to make it all legal like, and mom is in agreement, write up a new parenting plan/custody agreement, both of you sign it, and file it with the court. Don't be surprised if your ability to come to an agreement with mom re: this situation changes the second you mention court though.

It usually doesn't turn really ugly until the matter of child support is mentioned though.
