18 year old drinking in house with underage people??

What is the name of your state (only U.S. law)? New York

single parent who owns home has a 18 year old "child" living at home and has another child around 12 years old.

multiple times have alcohol containers been found around the house, and confronted 18 year old. she/he simply states that they do not drink, and that is was "jim's"(also under 21). this has taken place while the parent is either working, sleeping or not home. for the second time in the last 6 months, a bottle of captain morgan was "hidden" by the corner of the couch.

question is: if the 18 year old has their friends over drinking, even though the parent is not home, not aware of it, and has not purchased the alcohol, what liability is on the home owner? what liability is on the child??

a friend of the family, who doesn't want the parent to get into trouble because of the 18 year old who doesn't care

If the 18 year old is letting his friends over to drink, then it's time for 18 year old to get his own place to live. Unless, of course, mom does not mind losing custody of the 12 year old if the police come calling.

Tell mom that it's time to be a parent and become the master of her own home.
