2nd Dui in Md within a yr

I am 19 yrs old. I just got My 2nd Dui within a yr in Maryland i was wondering if anyone else has had this happen to them and what to expect. For my second one i was driving home and about less then a mile home when a Offduty cop saw me driving a little crooked and saw i had a flat tire and my other tire was all messed up.... He called for backup im guessing then as soon as im in my driveway stops me and then 3 other cops show up and i fail all 3 test and refused to take a breathalyzer.. I dont really remember every fact i was pretty messed up but the thing is the other cops never saw me driving but the one asked if i had been drivning that night i said yes i never really said when exactly i had been driving tho... If anyone has any similar situations or anything to help me then it would be appreciated.

This won't help you in this situation, but it may help you in the future, and most assuredly will help the mature, responsible people who may become your future victims:
From your post, we already know you are an idiot and hazard to others on the road.... your continuing to do so just proves our opinions are correct.
Do NOT DRINK AND DRIVE!! Get some help, you definitely need it (under legal drinking age and already TWO DUI's!).

Now, as to what might happen in court.... were you on probation from your first DUI?? If so, with any luck, that probation will be revoked and you will be sentenced to incarceration for the first one.... and additional time for the second.
With any luck at all, you will either not be on the roads at all.... or only as a passenger on a bus for a few years.

Driving in your case was established by the off-duty officer's observations.. It would be the same as if the witness were John Q. Public ... you were observed driving. Failing the tests and refusing the chemical test will mean an automatic license suspension and probably a guilty verdict.

You may want to consult an attorney as 2nd convictions usually hold greater penalties than the first time around. And apparently, the first time did not make a sufficient impression upon you.

I have a better Idea. Take a case of Jack Daniels, get in your car, drink every drop then drive like hell right into the first tree you see.

Problem (for the rest of us) solved!

I know in Michigan refusal of a breathylizer is automatic 6-months revocation of license. Second drunk driving is an automatic 1-year suspension with ignition interlock upon reinstatement. You will do do a minimal of one weekend to a year in in county, alcohol counseling, and most likely AA. If you live in an area with a high crime rate, chances are you won't do much time.

It stinks you are under age.

I don't know how much money you have but if I were in your shoes I would go for a GOOD dui attorney!
Like I said before it works to get the refusal but it you flunked all the other test I dont know.And you will lose your license for the refusal,so it's worth it to try and beat the DUI if at all possible.
I've been there except I wasnt under age, and didn't flunk the other test,except for cracking up laughing trying to say my ABC's backwards (hell I cant do that SOBER! :D )
Do you have any medical reasons you could have flunked it or made it worse b/c of that (ie:bad knees,etc)
Heck I'm not a lawyer,but it doesn't hurt to try.Thats what you pay for with an attorney.
Maybe I'm wrong,but you may as well go for it if you can find the money,AND do your research on the attorney! Make sure you get someone knowledgable, and willing to work and put up a real fight. :cool:
