Hey IM in North Carolina and am part of a HOA where there were 50 member. 48 of those members sold to the same buyer, BUT the bilaws state no one will have more than one vote. but now the new owner of all those units thinks he can run the HOA. He has spent HOA monies and even put the HOA in debt. SO I stop paying my dues. Now he sais he is sorry and will start to tun the HOA correctly but wants me to pay back 17,000.00 in poast dues. Is this leagal? Thanks for the help

Not sure, but ff you have not paid your HOA dues, many states allow the HOA to place a lien on the property or even foreclose.

Our HOA removes voting privileges of those not current on dues.

On another note, you and the one remaining single unit owner may want to ensure you are on the same page in regards to voting to ensure you don't lose total control.

You basically live in an apartment complex if 48 of the 50 units are owned by one owner.

Personally I would sell before the last remaining single unit owner does, or get together and do so at the same time.
