I have come to a conclusion that I will plead not guilty and try to work with the judge. If the judge won't budge and charges me with even more harsh punishment, I will go back with a lawyer.


One more question:
The insurance company will not see the 5 points on my NJ license in two years, but will they see my speed violation?


Thank you all for enlightening me on this subject. I would especially like to thank You Are Guilty for helping me make up my mind. YAG, you helped me so much, and I am sure you have done well for others as well. You are doing such a great job, I hope you keep it up and help more people get the second chances they deserve.

Licence points (for DMV purposes) are only viable for 18 months. Unfortunately though, insurance companies go back 60 months (5 years) when they determine your rates. So your understanding is correct.

When you plead not guilty, you will get a trial. The judge will not "work with you" regardless of the charge.

You cannot be charged with a harsher crime than you were originally unless the old one is dismissed and a new one filed.

If you lose at trial, there will be no going back with a lawyer. You will not receive a second bite at the apple. You will have to appeal if you are convicted and prove that the court made a legal error.

LINY86 I would appreciate if you post how your case ended.
I am in the very same situation as you were.
NY resident that was cought speeding in NJ.
My ticket was 100mph in 65mph zone and careless driving.
The difference could be that I was paced by the policeman-
not cought on radar.
Please let me know how it ended and what lawyer did you use?
