i recently recieved a 3rd DWLS while borrowing a friends car to get items to begin a carrer i graduated college for. no alcohol involved, as i voluntarily entered a 7 month outpatient program last year and graduated, and realized i was self medicating myself from a previous kidnapping and sexual assult by 2 strangers.
i hadnt been driving for over 18 months when i was pulled over(tag was run, no infraction)(from a dui in june of 2001) and was looking to get my BPO in 28 days. i know, foolish choice and i know im risking a bashing from most of you. but if there is one of you who can tell me if fl commonly gives jail time for this offense and if so how long (and i know some of you will say hopefully forever). i am 43, a daughter going to college in 2 months and a son going into the 10th grade, and i need to prepare them . i chose not to get an attorney but to plead guilty, my ticket charges me with a second degree misdemeanor, will the judge change the charge to a felony or will the charge stand as its written. I do not have a history of offenses other than these(bad enough though). thank you

Unfortunately the guilty plea and not getting legal representation were both bad moves.

If you check the roster of inmates in the Florida Dept. of Corrections you will find many serving one to three years for numerous DUI and driving on suspended license charges.

The guilty plea negates the opportunity to negotiate a reduced charge and arrange a deal.

Easiest to just talk to the children and hope you have a reasonable judge.
They will do a presentence report and with no other convictions I would hope you could come out with a fine and probation. Obviously your DL will be with-held for additional time.

i thank you for your reply. i went to court today and plead no contest. i discussed with the judge the improvements i have made in my life and tok full resonsibility for all my poor choices in the past. fortunately, she blessed me with 20 days of house arrest and a small fine. she had every right to give me so much more and i let her know that whatever she decided i was ready to accept. God helped me through and i feel so very fortunate. again, thank you for your response, you dont know how much just your reply gave me some sort of strength, no matter what the outcome. sue

Happy for you congratulations! You are more gutsy than I lol! Well honesty and humility paid off and you had a super understanding judge!

Always nice to see a suitable ending to legal matters! Did they take youe license for a longer period???

the judge said nothing of it, although i know DMV is a totally different entity. i can apply for the BPO beggining july 2nd. guess i should still go. need to bring a 30 day traffic search but the DWLS wont be on that. but i wont lie if they ask if i have driven. being scared of "no, you have to wait another year" is not one of my favorite feelings. relying on family and friendsbreak my spirits. but i have to try. with me they have to do AN INVESTIGATION, ect. im just praying and know that wherever he needs me to be , i will. thanks

yea i have to make a court date this week for the same thing ( my 3rd time getting caught with a suspended license) so hopefully i could come out of it like you SUE that would be awesome

I assure you that the chances of you receiving the same sentence as this woman did 6 years ago is remote.

Don't dig up old threads just because you finally found someone that got the sentence you wanted.
