I came to this site to get see if I could receive some input on peoples experiences with revocation of probation. When, I was instead attacked, I naturally became irritated. But, as the underlying reason for my question was to help me stop stressing, y'all have helped, in that I have been provided a real time comedy to take my mind off the stress. As for prosubpeona, she tried to insinuate that I had messaged her relaying that I had no lawyer. She also threatened to post my private message, which I then posted myself to rid her of her baseless accusations.

And my personal info? I came here many months ago asking a question pertaining to my custody situation, and was attacked just as I was this time. During this attack, I actually had to contact the site via phone because my personal information WAS released.

At that point in time I just assumed that pro had an issue with my case. After coming on this second time, I realize that pro just enjoys being haughty and condescending, and seems to find it pleasurable to viciously attack others who have very unsettling legal problems.

At this point in time, I have actually been able to on my own, gather some of the answers that I was seeking, but this was all on my own accord.

All of you senior posters seem incapable of either reading English, grasping
content, or understanding commonplace punctuation (ie the fact that the questions I sought answers to were ended with a question mark).
So now I am idling my time waiting for my ex to receive her ptrp.
 
Her drug dealer is hardly a reliable source of information. Is he actually willing to stand up in open court and testify that he provided her with the drugs that she's accused of using?

You might just find that your star witness is suddenly reluctant to follow through.

Your phone call is hearsay. It won't matter to the custody case unless, again, your witness is actually willing to stand up and confirm everything.

Frankly, you need an attorney if you intend to use this. You're not party to anything related to the newborn, and I'm actually surprised that anyone is communicating with you at all at this stage. In fact, there may even be privacy violations at play here.


First response. Has nothing to do with the questions I've asked. Incorrectly Decides that my recording is hearsay..... Did you know that even if it were, hearsay can be and is used frequently in cases to revoke probation? Look it up. Once again, pro, it doesn't matter how many times you state the sky is red, just saying something is, doesn't actually make it so...
 
The drug dealer will not take the stand.
I have a lawyer, and the phone call is not heresay.
Also, in Alaska, I read that evidence to revoke probation does not have to be beyond a reasonable doubt.

If you have a lawyer, why are you here?

And seriously - your lawyer is telling you that the court will accept that recorded phone call as evidence of something? Really?

Here she is second post, working on her favorite accusation... She's going to tell me I'm lying soon...

So, you lied - you don't have an attorney? That does actually explain some of your earlier posts.

That aside, you honestly - and I'm being completely sincere here - NEED an attorney to help you. You're in way over your head, and you're not grasping what you're being told.

Have you tried Legal Aid? Is there a local law library?

Have you contacted the State Bar Association to see if there is a low-cost referral program?
Trying to threaten me by posting my pm (which I sent privately in an attempt to not publicly point out that pro was being rude)

And following that threat by insinuating that I had admitted I had no lawyer?




I have a lawyer lady! Get some help! You're seriously disturbed.

I posted my pm so that pro would shut her mouth, and she did! Until other seniors came on and decided that since pro had said I had no lawyer, it was fact.

I see based on what you believe to be solid evidence, this forum is an absolute mockery.

But again, I am truly enjoying obsessing over something other than my custody case
 
If anyone has similar questions on ptrp, here is what I have found:

To arrest a probationer only requires that there is probable cause, as probationers have limited rights in within the legal system are considered to be peoples in prison

To revoke probation requires that there be a preponderance of evidence which can include, ooooooh, hearsay


As for the length of time it takes, this is determined by a po s workload. However, the arrest and second hearing are to be commenced rapidly.

Apparently, these loose rules on evidence and admission of hearsay are applicable nationwide, not just in my state.


But I guess y'all didn't know that, because you actually have no comprehension of what standard law is.
 
But I bet hearsay was a fun word to toss around seeing as you all have no idea how it can be implemented, and further are lacking the capacity to actually understand that the information I have doesn't even fall into the category of hearsay.

and I gave you the rules on hearsay evidence. Got a rule to support the admission of the evidence in your situation?

Wow! Coming here and reading a thread that sounded like something that would be informative has degenerated into all this trolling and bickering....

It's pretty sad when people who are on a board called "FreeAdvice" to give advice are only here to act like a bunch of elitists. It doesn't say anything good about those who are in the legal profession.

No wonder cops and lawyers have the kind of reputation they currently have.

This guy, or gal, is a mind reader. My sentiments exactly. The problem is most of the elitists dont have the credentials to be supplying the advice they give. The best advice youll receive here is to get a legal representation. :P That said, odb and layman seem like they do try to help. Not all the posters are here trolloling anyone who comes here looking for help. Unfortunately I think anyone that had a heart or was capable of empathy have already been forced out by the trolls.

I respect the police. They do a job I wouldnt have the fortitude to do.

I really should keep count of how many times Im called a liar or told that I have no credibility. People that dont know a thing about me passing judgement, while sitting in their comfortable computer chairs, in safe anonymity.
