What is the name of your state? What is the name of your state?
Louisiana.
My brother was sentenced to 60 years for attempted armed robbery and his lawyer was paid $10,000.00 to take his case and file an appeal if needed. That was at least 10-11 years ago. We cannot contact the lawyer ever and I was hoping and praying that someone can tell me and my family what to do to file an appeal or have his lawyer do his job...If there is anyone who could help me, please let me know what can be done.....Thank you

opinion only

i am from georgia and am sure the laws are somewhat different. however, i can't comprehend anyone gettin 60 years straight time on 1 count of attempted anything - even murder. were there several counts? as to the lawyer thing - most likely your family has lost 10,000. the prison system has legal libraries and your brother can get a court appointed attorney for an appeal. it just takes time. tell him to file or apply for an indigent defense (free)attorney over and over and over and over til he gets one; or file the motion himself - over and over and over and over. if he gets no results after another year or two - contact the media and bug them over and over and over again. if you want something in the legal world to happen - you must be very very aggressive.

I agree with ZCC - you don't get 60 years JUST for attempted robbery. There MUST have been something more to it ... like - he has been hit up with several prior offenses and strike entries that have all caught up with him under some form of LA career criminal or 'three strikes' type law.

he said his brother got 60 years.

HI CARL YOU TOLD THE MAN WITH THE BROTHER YOU CAN,T SEE HIM GETTING HIM 60 YEARS FOR ATTEMPTING ANYTHING, WOULD THERE BE A DIFFERENCE IN SENTENCING FOR ATTEMPT VERSES ACTUALLY COMITTING THE CRIME.

First, please do not post in all capital letters ... it's hard to read and in 'netiquette, it is considered "yelling".

And the difference depends on state law. Some states will punish an attempt the same as actually commiting the crime - this makes sense to me because why should we reward incompetence or dumb luck.

sorry about the capital letters

Thanks for telling me about the capital letters this is the only post i have ever made on this new computer of mine, soooo i am learning , but i agree about the dumb luck you are refering to, i was just curious as to what difference that would make to this particular individual, as always, you have helped me again, and someone else and many others i suspect.

thank you
