8 unit condo building being termited by tenting

Condo association in Orange County, California.

8 owners have been notified that in 3 weeks the entire building will be tented for termites. We have been told by our Association that we must find other lodging for ourselves and our pets for 3 days and that the "law" does not require any financial compensation to homeowners. Further, the termiting will be done in such a way that all plants permanently planted in the yards (within the plot map of the owner's property) will be included in the tenting. My research into Vikane and it's effects on life indicate that the gas will kill all the plants, sterilize the soil and regrowth can take up to a year. When I and one other owner objected to the killing of these yards (plants like fruit trees, vines and roses), we were told by an Association board member that this is just the way it is going to be and we have no recourse in the matter. Termites have been found in only one of the units but 8 households are being disrupted with no compensation. Is this legal? Can our Association use our dues to do this to us without even so much as a debate? Thanks for any quick advice as this Little Auschwits is happening May 16th, 2005.

Termite tenting

I also live in a condo/townhouse complex in CA with termite issues. I have been her 8 years and went through termite tenting 7 yrs. ago and face the same thing this coming year. Termite work is part of living in many areas of S CA
We had to move out with our cat and stay at a local hotel for 2 nights. We had to pay for that expense. The HOA fees and reserves do not cover lodging for this inconvenience. The reserve fund from our HOA covers the work only. The tenting did not kill off all our flower beds or landscape close to the buildings though, so I would check with the termite company.

Before the tenting, cut back and pot up as many vines and perennials as possible. I've transplanted and moved stuff in my garden around.
