What is the name of your state? Wilmington North Carolina :mad:

My husband has a court order visitation to see his kids on the 1st weekend and the 3rd weekend of every month. He even has a court order enforcing the court order. And another court order enforcing that court order for visitation. He ex wife still will not allow him to see his children. My husband has a court order for the sheriff in New hanover county to enforce the visitation order and the sheriff's department keeps saying it is a civil issue. The courts won't do anything to his ex wife to make her stick to the visitation order so she keeps the kids away. She know's no one will do anything cause the courts haven't done anything to her in over 4 years. We don't know what else to do. Please help, my husband really would like to see his kids. Thank you.

Thank you but we have done that over and over again. The courts won't do anything to her the just keep telling my hubby's ex wife to comply with the visitations order. Any other suggestions? :(

I thought the USA was more progressive than the rubbish and scandal that exists in UK law System?

Seems not...

You Americans should take a leaf out of our book here in the UK and start getting out on the streets to protest...nothing going to change until you do.
Kidsare just going to see their fathers and paternal line of the family get flushed down the toilet.

Frist, do you have an attorney? answer that then I'll give you a strategy I don't suggest many people follow and is a longshot but MAY be a possibility.

Yes we have a attorney all they keep doing is filing contemp charges each time the ex wife doesn't turn the kids over. The courts give a new visitation order but won't do anything to the ex wife. And she still won't turn the kids over to us on the 1st and 3rd week of each month. So we don't know what else to do can you help? :(

Can you also tell us how old the kids are?...and whether or not the kids had any past problems with visitation, or any specific complaints of their own? Technically those things aren't supposed to matter but sometimes they do.

The 2 daughters are 14 and 11. There has always been a problem with the kids. The ex wife has been doing this for going on 4 years. The kids do not have a problem with their father. They want to see them but the ex will not let them have any contact with there father. On visitation days the ex shows up with the kids and makes up a reason why the kids can't come like a sleep over a birth day party or the ex forgot the oldest daughter medication. There is alway a reason. We are on are last leg on what we can't do. The courts make visitation orders but the police won't enforce it. So where do we go from here?

If all your attorney is doing is getting a new visitation order then you have an idiot for an attorney. Go to his office and tell him to file a show cause for contempt of court each and every time this happens.

If, after about three of these filings the court nor the police will intervene, then file a Writ of Mandamus compelling the courts to order the police to enforce the contempt citation or to order a criminal contempt order.

Then let's see how things shake out.

Ok...now I am getting a bit confused. You say that she shows up on visitation days with the kids and then makes excuses? Does this mean that visitation doesn't always get denied? Does this mean that dad DOES have some contact with his children, however limited? Please clarify.

The difference between some visits but not all, or some contact rather than absolutely none, can make a big difference in legal strategy. That also could explain why the judge isn't coming down hard on mom.

You will get the best advice if you are very clear on the issues.
