I bought a used car from a dealership. 2 weeks later I took it to a mechanic to do a check up. I totally don't understand anything about cars. The mechanic (whom I completely trust - he's a close friend) said the car had been hit and the driver-side front fender and door had been replaced and repainted.

I was frustrated and went to the dealership. I told them the above and asked, why they didn't tell me anything about the damage (in a very polite manner). In response they were aggressive and showed me a paper with my signature that states "the vehicle is sold as-is with all bodily and frame damages. the dealership will not be liable for any of these damages". I checked my papers I had received on the day of purchase - there was no such thing, not even a copy of the paper they'd shown me. I think there should have been a copy of this. So, it gets me thinking they might have printed it in without my concern (just another guess).

I understand, I should have gone to a mechanic first, and check everything I sign. What's done is done. Please don't post replies with "should've"s.

The question is do I have a chance to stand against them for misrepresentation (hiding the fact the car was in an accident and doesn't have manufacturer's stickers in the left front fender and the left door) which is considered "fraud" in California code and cancels the "as-is" warranty?

It is your responsibility to have a vehicle inspected prior to purchase, not after. Car dealer have no obligation or legal responsibility to inspect the vehicles before selling them. Used car dealers do not have to disclose any known defects. Get a dictionary and look up the phrase "caveat emptor".

Need Help

I bought a car that never should have passed inspection. The dealer took it to a place where he always goes and they passed it. there is 3k of hidden damages on it. What can i do? the car never should have been sold.

CA. Hello, Looks like you have been had also, I don't know for sure but when I took my car to the dealership today they told me that it was a state law that a dealership had to inspect a vehicle before selling it to a consumer? I was hopeing that was the case, Any way good luck! :)
