What is the name of your state (only U.S. law)? Elk Grove, CA

This thread is based on the Adult Foster Family Home that I currently live in; the home is vendered through the California Mentor Network. I just moved into this mentor home on April 23rd, 2009.

I have only two question about civil rights. In general, does my mentor provider have the right to demand me not to take pictures of her family members when one of her family members does not mind in the first place? Does my mentor provider have the right to speak for her family in that situation? My questions is based on the story below:

On May 2nd 2009, this was one of my worst days yet, approximately 5:30 PM, I and Lilliana, Romeo , and Jenelyn (Romeo and Lillian’s grand daughter), went in Lilliana car, a Honda Accord brand, a dark green vehicle, to go to Roseville to watch a boxing match that was ordered on paper view. On the way, I asked Lilliana if she can stop by at the Bel Air that was very close by on the road. Lilliana replied by telling me that she wanted her privacy and that she didn’t want me to take pictures of her family; in addition, she said that she didn’t want me to advertise her family photos anywhere. My response to her comment was this, “You don’t have the right to speak for you family. You only have the right to speak for yourself.” Lilliana’s response to that was that that was her family and that she had every right to speak for her family; subsequently, Jenelyn, decided to back up her words by saying, “Yeah, we don’t usually take pictures. We take pictures usually during holidays.” I think she also stated this, “Yeah, we don’t want you take pictures.” I didn’t reply to Jenelyn's comment, but I was about to say something about what she said; however, I did say something to Lilliana.

At that moment when Lilliana insulted me, I became angry with her for saying that. I got angry with her because I felt she was trying to make me feel like I was an outcast. Also, I felt that she was trying to point out in some way that I wasn’t equivalent enough to be part of her family to take pictures; I also thought that she thought that her family was better that me in some way that I couldn’t take pictures. Obviously, I learned the next day that pictures were taken by her family except me. I learned that, Lilliana and Romeo’s son, took pictures that day.

After I felt insulted by Lilliana’s comment, I commented on Lilliana comment. I concluded my trip with her by telling her that she was rude and that I wanted her to turn the vehicle back around. Since she didn’t hear me the first time, I decided to raise my voice at her by telling her to turn the vehicle around to go back home. I said, “Turn the vehicle around! Do it now!” My yelling was not on top of my lungs; I only raised my voice 5 notches; therefore, even though I was yelling, my behavior was still considered civil; After I yelled at Lilliana, she said that she cannot leave me home alone (Later, I found out that, that wasn't true because my service coordinator granted eight hours of unsupervised time based on my dissability), so I asked her to drop me off on the cross street of Bruceville/Alpine Frost since they were on the road and as a alternative. On the way there, and while she was driving to that location, she tried to say something to me; thus, before she can start saying whatever she was trying to say to me, I told her to be quiet; consequently, she tried talking over me. Finally, I yelled at her again and told her to shut up. Then, she stated, “Do I not have the right to speak?” As a result of that comment, I told her that I just didn’t want to argue with her.

When we arrived at Bruceville/Alpine Frost, I got out of the car and walked to Cosumnes River College from that Target retail store. When I got to Cosumnes River College, I located a pay phone to call Lilliana cell phone number; I was going to tell her to pick me up at Cosumnes River College when she gets back from Roseville; however, she didn’t pick up her cell phone, so I decided hop on the Elk Grove Transit and go back home. When I got off my bus stop, I ended buying dinner at Panda Express. After I get done buying dinner, I head home on foot (the Panda Express is only walking distance to my house; from the Panda Express to my house, walking is only 3 minutes). By the time I get home, I notice no one is there, so I decide to take a walk to the closest park which is approximately one minute walking distance. When I got there, I decided to find a bench and start eating dinner.

After about an hour and a half, I head home. This time when I got home, someone seemed to be home. I saw the house lights lit up as I was heading home in the dark. Even though it was a few hours of me not seeing Lilliana, I was still upset with her over what she said in the car earlier. When I knocked on the front door, I realize the first person to open the door was Lilliana. At first glance, I decide to argue with her. I told her that I have the right to take anyone’s picture with there own consent and not hers; I told her that I was going to make sure that she does not take advantage of my rights again. Afterwards, Lilliana said that she wanted to drop the conversation, so I did; however, as I walked passed her by going to my room, I said, “you ****en slut.”

In my room, I sit down for a little while, after about 20 minutes, I decide to leave because I was still angry with Lilliana. I left to go to my local park where I went to eat earlier. At the park, I just walked around and about by myself. I took a long walk in the park until I felt better and fresh. By the time I got home, it was 2:00 AM in the morning. Coming home, to my surprise, I realize the lights in the house were still lit up. The person that answered the door was Lilliana's son named Erwin At the moment when Erwin opened the door, I saw Romeo and Lilliana up like they just woke up. As soon as the both saw me, they said they wanted to talk about me being home late; consequently, I was tired; also, I didn’t feel comfortable talking with them. I walked away saying that I was only going to talk about the conversation with Marissa. Just to clarify something, it is not a habit of mine coming home late, but that day was different. I had to take a walk because I was angry with Lilliana.

So far, I am planning to move out of this home into another mentor home because of some personality differences; however, I feel comfident that I will find me a mentor provider that will be a greate family.
