What is the name of your state? TX
I am trying to find out what my rights are, long story short I live with a abusive husband and have finally decided to leave. I have decided to leave the state to live with my family but don't know if he can charge me with kidnapping my daughter. I have him on tape threating to kill me and am confused whether I should take it to the police or just run. I have called the legal hotlines in Texas and from what i'm being told he has just as much right as I do even though he is abusive. Does anyone have advice on how I can do this?

I am not a lawyer but have been through the same thing, i called legal advice and they told me that as long as you are not divorced and just leave, you have every right to have your child with you.
I left without my kids cause i was afraid of being arrested for that too, but they advised me that if there were no legal procedures yet, i could take my kids wherever i wanted too.
That is the information i got anyways, hope it helps.

that is what I have been told too but don't know what will happen if he files for divorce first. I don't want him to file for temporary custody and then I have to bring her back.
