Hi! My boyfriend had the minimum required insurance by law and was working as a delivery boy for a local restaurant when he rear-ended someone. The police report and initial claim all said that he was at work and there were no problems initially. Then, nearly six months after the accident we recieved a letter saying that the insurance policy did not cover him at work so they have the right to refuse any claims. Well, the other party's claim was refused by my boyfriend's insurance and now they say he owes the money. Is there something that we can do? Is this legal? Should his work be covering him? He provided his work with proof of insurance upon hire and they did not tell him he was not properly covered. What can we do? Please help!

without consulting CA's regulations to know if this is leagl, then if the insurance policy has a specific exclusion against using the vehicle for work, then yes, the insurance company is well within their right to deny the claim.

as to whether he can hold the business liable, someone else will have to answer that. but my gut reaction is no.
