What is the name of your state? New Jersey

My sister has learned she is getting laid off from her job. She has about two and a half weeks of accrued vacation and wants to know if they have to pay her out. They do not have an employee manual, so no written policy on paid out vacation. They have verbally said that they would not pay out vacation you have not taken. Please help. I am in California and have been in HR for 8 years, but only in Arizona and Cali. Thanks! :confused:

New Jersey has no statute addressing vacation pay upon separation so it's entirely up to the employer.
