Yes, I am absolutely certain. Its a constitutional rights issue. Can I be certain that no judge has ever attempted to do so? No, I cannot be certain of that because judges make illegal rulings in all 50 states from time to time.

Well. CC has posted Cali law/statutes and I have seen WA. stat's that could prevent a pregnant mother from moving out of the courts jurisdiction pending the paternity case.

The WA case was several years ago and I am still trying to find it. I will ask CC to help with the Cali law.

I'm curious about the WA side - I've seen restraining orders put in place preventing BOTH parties from leaving (which frankly I believe is unconstitutional and would have been appealable had the parties actually known how to appeal), but I've poured through that RCW and can't find a thing.

I DO recall case-law coming out of California though. It's been discussed here once or twice.

Still looking for the WA thing. But recall Mom was PREVENTED/RESTRAINED from leaving the jurisdiction. Dad filed a RO and it WAS granted. Both parents were 17 if I recall correctly.

I can remember this being discussed....

(I'm still not convinced about WA - sorry, Blue - but I do remember it being said that a CA court had indeed restrained a pregnant woman from leaving the State. I can't remember the exact details though).

For some odd reason, I believe that was overturned when the judge was called on it. I can't find it, but I think it didn't stick.

I am looking through several k posts on another site. The father filed a paternity action and the mothers parents made it clear to the court that the potential father would be SOL. Judge issued a RO preventing the pregnant mother from moving until the child was born and paternity was addressed. In the end Dad was given custody.

I think this is a Case Law as opposed to Stat.
