Im a mother of two in Indiana. I have one child from a previous marriage. I was married to an illeagal immigrant, who's main intentions were for me to leagalize him. When I refused we got a divorce. He went his way and I went mine. Im now remarried to a man that wants to adopt my son. My ex, who refuses to learn english and communicate with my son, has no contact. He does pay child support due to garnishment. But has not seen or spoken to my son in 7months. I want to know if I have any kind of case that could make him give up his parental rights. Due to the fact that he cant communicate with my son because of the language barrier.

You have two choices here:

1. You can get your ex to sign consents to adopt so that your current husband can adopt the child.

2. You can ask the court to find that he has abandoned the child and that his parental rights should be severed. However, because he is paying support, this is most likely a loser argument.

The language barrier has nothing to do with his parental rights.
