HELP! I bought a new car yesterday at a large dealership. I was trading in a vehicle, but didn't have it with me when we signed the papers for me to purchase the vehicle. I signed all papers and they said I could bring the car in the following day. I took the trade in vehicle to the dealer today, and now they say that the car isn't worth the amount they gave me in the contract and they will have to renegotiate the contract or I will have to give the new vehicle back and take my trade in back. I have to go back tomorrow to talk to the manager (he wasn't there today). What are my legal rights? Can I force them to honor the contract they signed? The man at the dealership indicated I would have to pay more money or cancel the contract. What can I do?????????????????????

I would do nothing. I would not go and see the manager tomorrow. I would go for a drive all over Ohio showing my new car to my friends. Their loss. They made a deal and it's about time a car dealer got screwed - they screw everyone else.

But......

I dropped off the trade in today, but they still have my tags on the vehicle. I have to give them the keys (left the vehicle in their lot, but I have the keys still), so I have to go their to pick this up. Also, they need to pay off the loan on the trade-in, is there any way they could default on that portion? I did not misrepresent the condition of the vehicle, I told them the interior was in poor shape. The manager on duty today said he would never have signed a contract on a 'sight unseen' vehicle, but the manager yesterday did!

Any legal advise would be greatly appreciated. I want to be sure that they have to honor the agreement, pay off my loan and I don't have to pay any additional money.

The offer on your trade in was pending upon inspection. No, they do not have to honor the agreement. Read the small print on the contract. You will likely find wording to the effect that the deal is pending until approval of the financing and approval of the dealer general manager.

The only thing I could find on the contract about the trade in was that if you ordered a new car, they have the right to reevaluate the trade in once the new car is delivered.

The only other thing I found was a form we signed stating that the vehicle did not have a salvage title nor flood damage.

Where else should I look?
