They would theoretically take it back on trade for payoff. You might eat the tax. I don't know the purchase price, however it might be better to deal for a new one. They are offering 0% or $1500 on them. The dealer can give you below sticker, near invoice, if they choose to.

OK. I dont mind the tax I guess. But, I've paid on this thing for 4 months as well as put down 1800 for a down payment. Would they credit me that on the purchase of another vehicle?

I bought this one for my business (insurance). The loaner is nice and all. But I really need a car of my own and soon so I can conduct my business.

Yeah I figure I am going to be put out some. But for me, I just want what I am paying for and not something that is so badly damaged.

Do you think I need to talk to a lawyer here in town. I am way out of my league on things like this I'm afraid.

If you can for free, why not. I would be looking for a resolution you are content with, more so than a lawsuit.

That is what I am looking for; a resolution. I am not interested in suing if I can avoid it. I just want a good resolution to this and get back on the road in my own car.

I guess my main question is is what should I do? Should I talk to a lawyer here or just ride this out and see what the dealership offers to do? They still have my car.

And the first thing the dealership will tell you once you threaten them with an attorney is fine, they won't talk to you anymore, that you can deal with their attorney. And the attorneys will go shoot golf together and drink some high-grav beer. :cool:

See that is the thing...I'm not really want to go the whole lawsuit threat route and such. I havent said a word them about suing. I really didnt think about it until I talked to the salesman from another place. I just dont want to get screwed either. I just want all to be right and to be whole.

Talk directly to the Gen Mgr. They cut out commissions if no salesman is involved. Tell him you have considered the problem and researched the numbers. Make sure that you present invoice pricing for the model you want. (mainstreet (automatic) is 18100 or 16600 w/rebate.) Propose they give you 13,500 trade-in, paying off the existing loan. Fall back to paying off, if you need to. I think you will be much happier walking away with this.

I did end up talking to a lawyer here. After hearing what I had to say and such he thinks I have a good case and he wants to sue.

I talked to the dealership and they are doing repairs (and will throw in a set of tires to compensate me for the ones I had to replace due to the damage.) The dealership said they would fix the car at their expense and if I am not satisfied with that they will either A. exchange the car for one of equal value or B. buy the car back from me.

I believe the dealership is trying to make it right. Not thrilled about finding out the car indeed had been wrecked and badly repaired. But I feel the dealership is trying to make it right with their 3 offers. I'm not really interested in suing if that can be avoided. So I will wait until I the car gets repaired and see how it is and go from there.

Just thought I'd update my situation.
