Age of consent in Texas for gays?

Hi everyone. I'm sixteen years old and I live in Texas. My boyfriend is 18 years old. I turn 17 on June 6.

My boyfriend and I looked up the age of consent laws in Texas and it said that it was 17, but it was legal for straight couples as long as they are within three years of each other. Gays, however, have to wait.

Is this accurate? I don't understand how in this day and age this kind of discrimination can go on in our legal system. My boyfriend and I are playing it safe and not doing anything that could get him into trouble, and it's only a month or two, but I just wanted to know for sure.

My response:

I guess going to prison for your crime, and meeting Big Bubba, would actually be a good thing for you. Dropping the soap would be a welcomed invitation, right?

I looked at your states penal codes and it looks as though it is illegal for sexual intercourse between homosexuals. You are probably in the wrong state for that kind of open-mindedness. Here is the statue:


§ 21.01. DEFINITIONS. In this chapter:
(1) "Deviate sexual intercourse" means:
(A) any contact between any part of the genitals
of one person and the mouth or anus of another person; or
(B) the penetration of the genitals or the anus
of another person with an object.
(2) "Sexual contact" means, except as provided by
Section 21.11, any touching of the anus, breast, or any part of the
genitals of another person with intent to arouse or gratify the
sexual desire of any person.
(3) "Sexual intercourse" means any penetration of the
female sex organ by the male sex organ.

If you live in Tx, then yes you would be assuming correctly that if you and your boyfriend have sex as defined in the penal code, you are criminals.

Your responses rank right up there with Bobby Knight's "If a woman knows she is going to be raped, why doesn't she just sit back and enjoy it."

I hope you were trying to be funny, but the OP is still a kid, and suggesting anyone would like getting raped (which is generally what prison sex is), gay or not is irresponsible.

Thank you for going to the trouble to join just to post your ignorant response. The comments being made were not condoning rape but rather affirming the reality of the consequences of criminal behavior, whether some parts of society agree or not. We are not here to aid and abet in criminal behavior. This is not a rant site or support group.

You guys didn't even really answer my question. The anti-gay sex laws don't really concern us, as if my parents turned him in (a very remote possibility, but they don't know I'm gay and we don't want to risk it), I'd get in just as much trouble. Plus, no one ever gets convicted of those laws anymore, they're there just to appease the Baptists.

Statutory rape, on the other hand, would really only hurt him and people get convicted for that fairly routinely.

Now. My question was, what exactly are the age of consent laws in Texas for gays? After some rudimentary research I discovered that the three years seperation waver only applies to straight couples, but I really don't trust most of what I read online. Can any real attorneys verify whether or not the age of consent laws in Texas dictate that it is illegial for a sixteen year old to have "sexual intercourse" as defined by Texas law with his eighteen year old boyfriend?

Now. Does ANYONE want to answer my question?

You already received the legal response, there is no age of consent in Texas, for homosexual intercourse.
