I live in Mississippi. I filed adultery, but agreed to settle as irreconcilable differences at the end of negotiations. Can I still file alienation of affection against
the person who had an affair with my spouse? The divorce was final in 2003.

Actually, Mississippi is one of eight states that still has "alienation of affection" laws still in effect. All other states abolished them. You really need to check how your state applies the law. Basically, these are laws from the past when wives were considered property and "stealing" them was actionable. Later, women were allowed to file suit also. And, check w/a lawyer, it will not be a cheap lawsuit.

Is it worth it? Your spouse is the one who cheated & you divorced. Move on. Punishing someone else isn't going to make your life better.

I say that it also depends on your circumstances. A co-worker and her kids lost her house directly due to the divorce and her career suffered because of her marriage to a husband who moved alot.

The mistress was very well-off.
The co-worker worked with an attorney on commission basis and she won alot of money for a different house AND money for suffering for her AND her children.

But if the mistress is not well-off, you won't get anything, so no lawyer will touch it...unless you have alot of money to waste.

Are you this desperate for money? And what if you lose? Are you willing to pay your legal fees and hers?

You're divorced, get a life. The best revenge is happiness.
