I divorced in Ct but have since remarried and moved to NH,where I have earned 1/2 of what I earned in CT. A few months ago I got laid off and havent found work since. Can I stop paying alimoney while Im unemployed, and would my spouses income enter into the picture? She does earn good money but pays out a high percentage of it in child support to her ex.

My response:

Not without the court's permission. If you stop on your own, despite your financial situation, you'll subject yourself to a "Contempt of Court" hearing, with the potential for fines, community service, and / or jail time. You had better initiate a Petition for temporary modification of your support payments.

Your spouse's income plays no role in your debt obligations. However, while you're looking for work, your spouse could help to pay your court-ordered debt to keep you out of jail - - if you're on good terms with your spouse, that is. Who knows, maybe she wants some "alone time", and wouldn't mind if you sat in jail for a couple of weeks. Hey, its happened !
