What is the name of your state? Delaware

I have been divorced 2 years and my alimony order has two parts.
one regular alimony payment, this I can claim on my taxes.

The second part is a maintenance agreement . Basicly it reads that I will pay my X wife's medical coverage through Cobra. in return she will not touch my retirement. This is a separate payment to her in cash (check).

Question. May I claim this ammount as alimony by claiming it to be a Separate Maintenance agreement.
