What is the name of your state (only U.S. law)? South Dakota
On 7/18/08, I mailed a check (payment in full) to Alltel. After my due date passed, I got a text message that my bill wasn't paid. I contacted my post office & was told either the mail was in a plane that had gone down or was stolen. I paid my bill via my phone & put a stop payment on the check which I was told was good for 6 months.
Fast forward - a person stole some 30,000 pieces of mail. After he was convicted & sent to prison, the police found this mail in a storage unit. The mail was to be returned to consumers unless there was no valid return address. Then the mail was sent to the company that the mail was originally sent to. Now the company I work for, opened all the envelopes & sent the payments with a letter back to the customer.
On 5/13/10, I was checking my on-line banking & see an ACH for $97.74 for Alltel. I call customer service & was told either I mailed in a check or took one in to the store. My bill comes out on 5/10/10 & was for $90.02 - I hadn't even received my bill yet. Alltel told me I needed to dispute with my bank. I called the bank & Alltel was sending through my check from 2008. The ACH was denied & I was returned my money. I called Alltel to let them know that they were cashing a check from 2008 but kept getting "You have to take that up with your bank".
On 5/17/10, I was once again checking my on-line banking & see that Alltel is now sending the check through. I called the bank again & they would research to make sure they could deny it since it was 22 months old. I again called Alltel only to be told I wasn't on automatic withdrawal but they would be happy to sign me up for it. I asked them how many times they were going to send this check through & the credit customer service rep could not tell me. When I asked to speak with a supervisor, I was told they were the highest I could go. My bank returned the check as "stale date" & I was returned my money.
I am not looking at gaining anything financially but wondering what I can do to get Alltel to stop running this check through? According to my Alltel account, they are showing I have a credit of $97.74 - they are only showing the ACH payment, not the check - they have both been denied or returned. When I call to try to straighten things out, I am directed to talk to my bank.
