Well, tomorrow is my arraignment. I'm going to plead "not guilty."

If the judge asks me why did I follow her, I'm going to say the following, "Your honor, she and I worked together for 5 months. We were in a team of 5 people. We use to joke a round, laugh together and we were close friends. Afterwords, she quit from her job because she stole $900 while being on probation. The police found her guilty, so I tried to help her your honor. I told the girl that she stole the money from, please don't press charges against her because she is 20 years old, she has a future in front of her and because she is on probation and I don't want her to go to jail. I know that she needs help your honor because if that girl pressed charges against her, she would be in jail because she violated her probation. So, when I went to see her on that day, I went to see her as a friend and to let her know that the girl is not going to press charges against her, so she doesn't have to worry, because I know that she was under a lot of stress your honor and I wanted to help her, but now, look what she is doing to me your honor. I never thought that she would press charges against me for trying to talk to her and for trying to help her, but from now on, I don't want to see her or talk to her your honor."

What do you think all? Is that good or not good enough?

Plead not guilty and keep your mouth shut. At the trial, let the government prove everything. Oh...and keep your mouth SHUT.

Whats that saying? "I had a perfectly good case until my client opened his mouth and ruined it" or something like that.

War story:

A defense attorney just told me this.

He had a client that was arrested on a first DWI (6 months/$500 maximum). There were no FSTs, no breathalyzer (refusal), the cop was an idiot and a liar and the atty. assured his client that he could get him off practically scot free.

The client (no OPL remember) shows up for a deposition. After the deposition, atty. asks client, "How did you get here?" "I drove." [Severe chewing out ensues.] Client assures lawyer that client is very sneaky and no one suspects anything because he parked a block away in an alley.

Client goes to car, starts it and hears a tapping on the driver's side window. Friendly deputy. Now we are up to a class A misd plus original charge.

The next day, def atty sees prosecutor at post office. Prosecutor tells def atty that prosecutor will have to recuse. Why? asks def atty. "Because your client tried to bribe me." Class A felony.

I know, I'm not going to say anything except my plea, which is "not guilty." But, at the trial, shouldn't I say something? I mean the judge is going to see the video tape and that I tried to hold the door because the incident happened at the mall in a parking lot. That's what the police officer told me.

I mean at the trial, my lawyer or I have to defend our case, right?

This is my first time in court, so I don't know much.

Well, today, I went to my arraignment and I wasn't that nervous to be honest. It was my first time in a court room.

The judge asked if I have a lawyer or not, I said, "no." He said, "do you want a private one or court appointed?" I said, "court appointed." Then, he asked one of the two ladies that sat in the front if I qualify for one, so she said that I don't qualify for one, then he asked if I want a private lawyer or if I want to represent myself and something about "insurance." I said, "insurance," but I didn't understand what that is really.

Then, the prosecutor read my charges out loud and said that I was ordered to stay away from that girl. Then, the judge gave me "probation" till my next "pre-trial" and said that I can't go near her, but If I do, I will be arrested for 60 days without bail.

My next hearing is next month. It is "pre-trial." For some reason, he didn't ask me about my plea. I don't know why. oh, the girl did not show up, which I expected and I'm very sure that she is not going to show up next time either.

I don't know if I should hire a lawyer or not. I'm 99% sure that the girl is not going to attend the hearing next time.
