An Accident, A Claim, but no Legal Citation.

A couple months back, I was in an "accident". I wasn't paying attention, and my vehicle left the roadway. I hit a tree, totalling the vehicle. A claim was made and recieved. The police officer on the scene said that I would get a citation within a couple of weeks if I got one at all. His reasoning for not citing me would be because the side of the road was muddy due to construction work.

It's been a couple months, and still no citation. I'm assuming that I won't get one. So, does that mean that I'm technically not at fault? If I did not violate any traffic violations, am I not at fault? Will my insurance premiums raise because of this incident?

I ask because I currently do not have insurance. I haven't been driving since.

your insurance might increase because you had a claim. If you got a citation that would also increase your premium.

Oh. I guess I should have mentioned that the vehicle was under my mother's name. My mother made the claim.

I intend on consulting another company for insurance. Will they need to be notified of my incident? If so, will they increase my premium based upon it?

You are 16 and you already totalled a car because you couldn't control it, or drive at a safe speed and maybe got off on a technicality.

You are still a young driver and you say you haven't driven since.

We also know that recently you were cited while a passenger in another car accident where again the driver took a turn too fast and rolled over and you were a passanger but cited for underage drinking.

Then you say to a 14 year old girl that it is ok do have sex with an adult, just be sure not to get caught, something you haven't learned to do very well.

You say if you don't get caught, it's not illegal.

Do this:

Go down to the police department and ask them if you are going to get cited for your accident, also ask them if your underage drinking charge will make any difference in their decision to cite you, also let them know you and your mother submitted a false claim to the insurance company claiming your mother had the accident so the points should go against your mother's driving record, not yours! Maybe the police will want to help you both out.

Don't ask us about what will happen to your insurance, because we can't tell you. Call the company, tell them you had an accident and totalled your car because you were not paying attention and driving too fast in a construction zone, that your mother made a false claim and that you also have an underage drinking citation, you have to report these and you want to know what will happen to your rates and your Mother's rates?

When you go before the judge for your underage drinking citation, let the judge know when you get to make your statement before sentencing, your beliefs about what is the law and that it isn't illegal if you don't get caught. Let your mother be a charactor reference for you, tell the judge she loves you so much she files a false insurance claim to protect your record, that must make you a very good citizen. Ask the judge if he has a daughter, if so, let him know that you think it is ok for 14 year old children to have sex with adults. You might want to ask him how long your license is going to be suspended before you worry about insurance or driving for a while.

Also, Please, Please, wear a helmet and get a three wheeler instead of a bicycle it won't tip over so easy taking turns when you don't have a license and are out drinking. Remember you can get cited on your bicycle also. Remember to put one of those big warning triangles on the BIG basket in the back.

You live in Pennsylvania, don't think that you can just get a cart and buggy, when your license is revoked, you have to feed and take care of the horse so you wouldn't have enought time to go out drinking with your buddies, although that might not be such a bad idea. :)

The insurance company is quite aware that I was the one involved in the incident. I haven't gotten cited yet, so I probably never will. It was at the officers descretion, not a technicallity.

Also, they MUST disregard that when I go to court for my underage drinking charge, and if I am found guilty, they can't take that into concideration upon deciding what to do about the accident. Each charge must be decided independently of the other. I thought that was common knowledge.

I have not plead guilty to underage drinking, and have a good chance of having it dropped.

"It's not illegal if you don't get caught" was sarcasm on my part. I don't usually get caught. I have done a lot more than drink under the age of 21 once. I'll leave it at that.

It is obvious that you have done a lot more but have not got caught, one of these days your mother will be IDing her precious son on a slab.

The best way to not get caught is to not break the law.

Please wait to drink until you are of legal age, then don't drink and drive, if you and your buddies go out have a designated driver, then no one gets caught DUI and don't have possession of illegal substances either.

I am definately more cautious now than ever. Having been in two accidents.

The one thing I will NEVER do is run from the cops. I've seen more people die that way than for any other single reason.

If I do get the underage drinking charges dropped, I will take it as a warning, not as my calling to go out and wreak as much havoc as possible.

I wasn't drinking at the time. I do not have an alcohol problem. I do not need help. I'm not stupid enought to drink and drive.

first stage is denial and also you had been driking before yu got in the car....you are going to tell the story the way you want us to hear it>...i am done with you. Your are a lost cause.....a 16 yr old know it all... :rolleyes:

The worst thing possible is for you to get out of any of these charges, that will be the wake up call and possibly you and your whole family, your mother and equally wreckless brother who was driving the car in the other accident you were in, no wonder your family is looking for new insurance!

I was mistaken, if you and your family don't get help, your mother may be looking at two mangled corpses laid out on slabs or explaining to everyone how her precious boys couldn't have caused the death of innocent victims of their INCORRIGIBLE ways. The best thing is that when you go to court the judge recognizes what is happening and declares you incorrigible and sentences you to a facility or program for troubled youth where you might get a real awakening and some help.

During the time these posts were made last night two accidents occured involving teens.

The first involved a teenage male driver and his 4 female passangers all between the ages of 15 and 18. They were going down a hill where the speed limit was 25 mph it is estimated they were going 65 mph. They flew 125 feet into the air and hit a tree. The only occupant wearing a seatbelt, a female, lived, the others died, the worst accident since 1990.

A few miles away, I actually heard the screams of the emergency response, 4 teenagers driving down the freeway slammed into a parked moving van well off the side of the road in a designated area. No one in the moving van was injuried, all occupants of the car were killed, the coroner is performing autopsies right now to determine if drugs or alcohol was involved in this accident.

They have not released any of the names of the victims, only the city where the one survivor lives.

JohnnyN, I am not kidding when I say if you don't get some help your mother will be IDing your body on a slab, while you were so glibly scoffing at the law, 8 parents in this one small area, will have make say that horrible good-bye...

In a few months time you have been in 2 major 1 car accidents, charged with underage drinking, are you waiting for the 3rd to break the charm?

You admitted to doing a lot of things for which you didn't get caught.

GET REAL and get some help!
