What is the name of your state (only U.S. law)? Ohio

I received a phone call today from the ex. Basically, he said-- I'm done, come get them. His most recently moved in girlfriend has just moved out, and his mother is refusing to help him out by watching the children for free. So, he's decided that it will just be easier for him to continue his lifestyle sans children.

So, what needs to be done? This should be a simple thing since he is agreeing to give the children to me, yes?

normally it should be. you can fill out a stipulation for the change of custody and ask him to sgn it. you would then file it with the court for a judge's signature converting it to an order.

if he doesn't sign, or is a arse about it, just leave it. wait 6 months for status quo to kick in and file based on change of circumstance.

Congrats Momma. Make sure to have custody paperwork filed before you leave with them. I would not raise the specter of support until you have the papers signed. When they have been in TX for 6 months, file for a change to TX courts.

Oh I'm not even worried about support at all. I can take care of them just fine without a dime from anyone. I plan on waiting until I get back to Texas and get the case moved here before I raise any kind of support issue-- and even then, I wouldn't care if they only ordered him the minimum. My kids are going to be in a safe, stable environment and that's all I really care about.

Congrats MommaBearX3. You just passed the FA one hour course on successfully navigating an incorrigible coparent. Pick up your diploma on the way out.:)

Once I am SAFELY back in Texas with the kids I will be sure to thank the posters, peanut gallery, the Academy, and the Republic for which it stands.

:D
