the city said that they do not care if i rent it out as "room"

will renting it out as a utility room help prevent any issues with an unwarranted unit where someone will live in it? what are the implications? or best way to manage this?

Is anyone living in the “unwarranted” unit? If so, does this person have a lease?

There should be no issue in purchasing the property - just possibly in how the property is used after purchase.

if it is to be rented someone would live in it and have a lease.

The room needs to meet whatever the code requirement is for someone to live in it. If it doesn't then you can't rent it out to have someone live there regardless of the label you put on it. Calling it a utility room does not suddenly make a room that doesn't qualify as a bedroom by code a room someone can live in.

I think that we might not be understanding you fully.

What kind of building are you wanting to buy? A building with multiple apartments and one unwarranted? Or, is this basically a single family unit with an unwarranted apartment within it?

The fact that the city said that you could rent it out as a "room", kind of leads me to believe that at least the city is telling you that you can rent it out to a roommate, you just can't call it an apartment.

I am confused about why you would want to call it a utility room.

So, if you could explain things a little more fully, that might help us give you better advice.

Having said that - the OP is free to rent out a portion of his unit for storage, and that's how I interpreted it.

I get the impression that English is a second language for the OP. His phrase "utility room" contradicts his statement that someone will live there. That is why I wanted a better explanation/description of the situation. It is either a real utility room in an apartment building that has been turned into an illegal studio of sorts, or its a kind of mother in law suite in a single family home, that may have a kitchenette and it's own bathroom.

In the first scenario it's only legal to rent it out for storage. In the second scenario it would be totally legal to rent it out as a bedroom, but not legal to rent it out as an apartment.
