A tenant of ours stepped on a roof nail outside the house she rents from us. She got an infection that required the removal of a toe. We had a new roof put on the house before we began renting it to her. She has incurred medical bills in the thousands, if not tens of thousands. We were obviously stunned upon hearing about this freak accident. It never dawned on us that stray nails from a roof job could pose a hazard. Our insurance policy includes personal liability coverage of up to $100,000. But we are wondering if we can be held liable in court if we are sued.

Probably , the tenant could sue for over any amount not paid by insurance , plus pain and suffering , and loss of toe .

You in return sue the contractor .
