Assault w/ deadly weapon

What is the name of your state? CA

My boyfriend was arrested and served time for assault with a deadly weapon when he was 16 years old. He tried to seal his record but is unable to because his offense falls under 707 (b) category (sorry, I am not really clear on the lingo). He is 27 years old now and has graduated from college and is pursuing a career in healthcare. Is there anything that can be done to clean up his record? Expungement? Certificate of Rehabilitation? Destruction of arrest records? And what are his best bets? He is really depressed as he will need to apply to the state board for a license to start working and is scared that he will be denied. It is unfortunate that one mistake made as a impressionable teen will cost an adult a bright future. Thanks for listening and any advise is appreciated.

Do you see the irony of your statements?

There is no way in hell his record is going to be sealed from the eyes of the State Board. He may as well seek a career with Burger King.

Depending on which area of healthcare he is seeking employment in, he may be able to petition the board for a review. This will just mean that he can present his case to them in person so that they might have a better idea of the person and his accomplishments since his offense.

As IAAL points out, assault with a deadly weapon will not sit lightly with the board, and he may need to adjust his ideas now for employment....

I have seen professional boards pull the license, registration, internship, trainee, associate..... for offenses occuring in high school that for which they were never charged or convicted. These are all things he should have considered long before this time. Most plans for careers are made prior to age 27. The fact that he failed to consider this, demonstrates poor judgement.

My response:

Not from the all-seeing eyes of State Agencies. Public safety is the overriding factor.

And the phrase is, "tried as an adult", not "trialed".

There are ways to petition for a record to be "sealed", but that does not mean it will be sealed for the purposes of professional licensing.

Tried as a minor

but because it falls under a 707 (b) category the record cannot be sealed or expunged. He was 16 when it happened so he was charged and tried as a minor and graduated from the youth authority and everything.... I guess the gray area arises from the fact that he was a junvenile, does that give him any kind of leeway when disclosing to the state board? We are looking for a attorney who specializes in juvenile/criminal law to see if there is anything we can do about this. Anyone with lawyer recommendations? Thanks
