Asset Acceptance Defeated

Today was court date. I had all the information I could, much from this forum, a lot of it from Ladynred and others. I was prepared to argue their amount claimed, their date of last activity. That the statute of limitations was up by the definition of an open account (in NE SOL for written is 5 years, unwritten is 4 years). I got to court and I was not on the docket.
The attorneys office had called and cancelled. I had sent a validation letter (I got it form Bud Hibbs, at budhibbs.com) and they were unable to reply. They did not have the documentions to back up their suit. If I had not done this, and had not been ready to go to court, they would have won a judgement I could not afford.

Maybe this can help someone else, and once again, to all who helped.

:D :D Congratulations !!

Just be wary, unless the case was dismissed WITH PREJUDICE, ASSet can sue you again. I doubt they will given that they would still have no proff, but I'd watch 'em for a while anyway.

Thanks, I was aware by reading, probably on this forum, that with prejudice means that they are still allowed to file suit again. But as you said, with out the proof the chance is slim and the SOL has now clearly passed. I intend to file all of this for quite a long time, so that I have the fire power to just knock them clean out of the water if they try. I wish I found this forum and a few of the other web sites a long time ago. I will recommend them to anyone with problems. You go through quite a few websites, before you find some that are reallly there to help you and not just sell you something. Even thoses services that offer to help you find a lawyer have been useless. If any one else cares, budhibbs.com and fair-debt-collections.com have been helpful. Bud Hibbs, or some one who works for him will usually answer emails. Not always the answer you want, and sometimes it is just to contact a lawyer, but he answered. Thank you again to Ladynred and the others. :)
