If I have signed all of the closing and settlement papers and I am 2 days past the rescission time, can I put a stop payment on a check that I had mailed to the title company to pay my Nov. payment that they had already included with my settlement fees through the mortgage with them.
The problem is my FEDERAL Truth In Lending disclosures do not match what is actually on the HUD Settlement Statement (which we've already signed).
About an hour before we were due to have the notary at our house to sign the closing paperwork, the mortgage banker called ONLY to advise that the debt being paid off had to be switched around to accomodate the debt-to-income ratio, nothing was ever said about the fact that they just took our property taxes and homeowner's insurance costs OUT of the amount of the mortgage payment. The mortgage payment remained the same due to the scrambling of the debt that they had done (which I might add they took off $2800 to be paid and added only about $900 so how COULD the payment be the same?????). So now I have signed paperwork with about 4 different amounts and I am 2 days past of the rescission period but the loan has not yet funded. So I am wondering if I can legally stop pay on the check to keep it from funding as that is what the title company is waiting for to continue with the funding process............
