Even though a person works for a non union co. in an at-will state and is unjustly fired, and could find an attourney willing to take it on, would'nt it then be up to a jury to decide if damages should be awarded?
I don't have specific problem at this time,
but have always been curious about this since
employers nowadays need to be more carefull
how they treat their employees than they would have 25 years ago.

The case likely would be dismissed on a demurrer or summary judgment motion and never go to trial on the facts you gave.
