attorney collecting debt?

What is the name of your state? Pennsylvania

I received a phone call from an attorney's office in GA about a past due credit card debt of $5100 from 3 or 4 years ago. I offered to make payments and the woman told me that the minimum the creditor would accept is $425 a month. I said that wass more that I can afford but I would try. I was unable to make that payment for September. I got a call on Friday that said I have to call her Monday and make a payment because I broke out agreement or they will sue me. If they do sue me I will still only be able to pay $25- $50 amonth until I go back to work. I was laid of a few weeks ago. Can they garnish my wages when I go back to work or attach my bank account? Can they attach my husband's account if it's not a joint account and the debt is in my name? I would like to clear this up as quickly as possible.

It is illegal for CA to threaten you with lawsuits unless they plan on filing. But you will have a day in court before they start garnishing your wages or freezing your bank account.

So, should I just start sending payments? Should I request to make payment arrangements in writing? I really don't want to have to go to court. I would like to just clear this up by making payments.

You can send however much you can. But creditors and CAs don't automatically accept your offers. Unfortunately, you don't have your way in these matters since you agreed with their terms and conditions.

Now, if you keep sending the payments, you will be looked much more favorably by judges during your day in court. It may or may not happen, but you should be ready for it. Good luck.

When did you last pay the orginal creditor? THe SOL on cc debt in Pa. is 4 years. Also, wage garnishment is not allowed in Pa.

People are so easily scared. It's a collection agengy..nothing more or less. If they don't accept your offer, tell them sorry, and hang up. They'll call back and take the offer.
