Howdy:
I have been in bankruptcy for well over a year.I have been through three or four attorneys so far and am on my fourth,or fifth.Could someone please tell me what an attorney's obligations are toward my best interest, and what the law requires of them?
There are a few items in my bankruptcy that my attorney doesn't seem too interested in taking care of.One, is the simple fact that my property is being purchased by contract for deed.For over one year I have been making my land payments to the guy I bought it from.(This is according to the way the court deemed it should be).For that length of time,the guy I bought the property from has been collecting the rent on another trailer on the property I'm buying.He is now, being as I am in bankruptcy,making about $300.00 more,per month, than he is supposed to make according to my contract for deed.(My contract for deed instructs that I pay $528.60....He's collecting that, plus $250.00 on the other trailer....plus, the people on either side of me are not paying me for the use of water from my water well of which I am paying the bill for).
These things alone are creating a hardship for me.Isn't it the duty of my attorney to address these items first and foremost?....Along with all the normal court filings,and procedures?
I have asked each and every attorney I have hired to help cure this problem,and each and every one of them didn't seem too interested in doing so.
I originally filed chapter 13,Pro-Se. I then got an attorney to take the case.I had to discharge one attorney while in the court and question witnesses myself because all he could say was "I have no questions,Your Honor" This was a hearing for motion to dismiss,as filed by the holder of my contract for deed.
Can someone please tell me what to do and who to contact as to what I can, and should expect from an attorney?
