Had an accident in Florida 2 1/2 years ago. We were rear ended while at a stop light at 50 mph. Got a lawyer here in NJ. Just can't seem to settle this case. I had a bad burn on my left hand, some minor facial cuts and abrasions and whiplash. I was treated for 6 months. My wife suffered soft tissue damage and was treated for over a year by chiropractors and an acupunturist. She still suffers from intermittent neck and arm pain. We did not miss any time from work even though we could have and in hindsight probably shuold have.
To sum up, our lawyer has'nt given me any positive info regarding our claim and states,"well, you were'nt hurt bad enough" and the accident happened in Florida so gee whiz".He hooked us up in Florida with a lawyer in case we bring suit there(since we can't sue from New Jersey)and this guy was just as negative and claims we would have a good chance of losing the case there!!! The other drivers insurance company has offered $5000 each to settle which my lawyer rejected. He says my health insurance company wants $13000 in medical costs reimbursed from the settlement.Obviously this won't work especially after he gets his 33%.We are totally confused as to how to proceed from here. We are'nt looking for 1/2 a million $'s or anything near to it but I think we deserve more than whats been put on the table.

Need help !!! My 6month old car was totalled by the way
 


You are not going to get any responses on this site because you've already had two attornies in two different states tell you the same thing.

FYI: In Florida bodily injury damages are based on an injury threshold not a monitary one. In theory anyway, you are compensated based on how badly you were injured not on how much your doctors charged you.

Also, if you don't pierce the tort threshold you are only entitled to your out-of-pocket expenses.

Well the reason I posted in the first place was to get additional feedback regarding what I believe is a ridiculously confusing case that should be pretty cut and dry. Hey, maybe I'm dealing with people that are trying to scare me off or have gotten lawyers that are'nt willing to fight for me. I'm not a lawyer and don't have the habit of engaging in lawsuits. We're definitely being taken advantage of since we're out of state and now I'm assuming that we the victims will be victimized again as money hungry profiteers that are trying to take advantage of the system when the system is taking advantage of us. Yeah, I take exception to being made a victim a second time around due to no fault of our own but the total negligence of the other driver. I'll take my chances on this board that someone will have some solid advice on this issue. Just because my lawyer says something, it does'nt necessarily make him right. Still angry with every right to be.If no one wants to respond on this board then so be it.
