Southern California. A person hit my parked vehicle and has a $10,000 limit for insurance. Although my vehicle is going to be repaired within these limits, I feel there is a substantial diminished value which should be taken into consideration. Since the repairs on my vehicle and rental bills took all of the $10,000, do I have any case towards the insurance company to claim a diminished value or do I have to go after the other driver? The insurance company is telling me that they are only going to pay the $10,000 and that is it. I asked them to put that in writing and they refused to do so. They want me to sign the release of liability and then they will talk about the diminished value. After reading the release of liability, it is my understanding that I will be agreeing not to pursue anything anymore against the insurance company or the insured. Please help.

I'm not an attorney but if I were you I wouldn't sign ANYTHING until you have spoke with one--once you sign they are off the hook
