I'm serious though, really, think about it. How are you even going to know if he is cursing or drinking around the baby. And even if you do know, how are you going to prove it?

Are you going to file contempt every visitation saying Dad said damn, or Dad had a beer after baby went to bed? Do you not think the judge is going to get irritated with you after a few of these? Your energy would be better served elsewhere.

Now if Dad gets a DUI with baby in the car, then you have documentation that dad is a danger to the child, and nothing needs to be in the court order to make that stick.

If you just want it in their as a scare tactic, and you think that your parishes court will ok it, then great, but you just need to realize, that they aren't much more than words on paper.

I agree, they are just words, but to understand the whole situation, I would have to bear some private matters, that I care not to discuss on here, that I know will help my request: On the alcohol issue and the overnight stays. I do understand that my petition is like a request, asking for things, not meaning they will be granted. But in hopes, and in similar cases as mine, with our history, I have seen some go through and some don't. I understand it's a request, doesn't mean it's going to be granted. Thank you though.

"No-alchohol" is impossible to enforce, and pretty extreme.

My hubby and I are very responsible older parents. Neither of us uses much alchohol at all, however, we DO dine out, and we DO bring kiddo with us (our parents are deceased and finding sitters is not easy in my area), and we DO, on occassion, order a glass of wine, a margarita, or a beer, as meets the occassion.

Be advised also, that certain RELIGIOUS observances include the presence of wine. Jews and Catholics and others may utilize wine in a service. Thus such a prohibition may interfere with Dad's right to religious observance. Anyway - there is a DIFFERENCE between modest consumption of alchohol socially, and alchohol abuse.

Alcohol abuse, not "NO-ALCOHOL"

much appreciated... BB
One thing though, CJane's parental plan and the petition I am drawing up, only have a couple differences. the age is until he is 1 year of age. and that there's no alcohol around the child by either party or profanity to be used around or at the child by either party. Last, no overnight stays unless married by either party. So, you think that plan would work, but not mine?

Each state has its own definition of alcohol abuse. At what blood alcohol level would you consider it alcohol abuse.. at .05 when there are reduced inhibitions, at .10 when there is slurred speach, or at .20 when there is euphoria or motor impairment? Who is giong to be there to monitor his alcohol intake and consumption?

I know you have seen the other threads as well, so, I make my correction public, I meant "ALCOHOL ABUSE"... and I have good faith in the judge and his judgement, because of circumstances...

The sad part is that she thinks she is going to be able to do all this without a lawyer and be coherent when speaking to the judge, and preparing legal documents herself. Scary.

LOL but I guess she expects the Lawyer's that volunteer their time here, to hand hold her way through the whole process. I could be wrong, but I'd lay odds that aint happening. ;)

My point was/is that you would not be getting bashed quite so hard if you put a bit more thought into what you are attempting to relay before you start typing.

YOU'RE the one who made a big ol' deal to nextwife about alcohol abuse vs. NO alcohol.

Doesn't take a genius to see that you just babble about whatever thought pops next into your head. :p

And as far as your "veiled" insults, you are pretty rude for someone who NEEDS our help. No one is a washed up attorney. Some are attorneys. Some of us volunteer IRL and online.

Some of us are just old meanies who enjoy giving out wrong advice, just to watch you newbies twist in the wind whilst we cackle at the ruination of your so-called lives.

Sure do hope you can figure out which is which. :p
