Why not let the baby have the dad's last name? Is the baby a boy or girl? If it's a boy I think it is the best thing to do to let the child carry on his dad's last name. My step son has his moms last name and I think thats b u l l s h i t . Me and my hubby have a daughter together and before me and hubby were even married I gave her his last name. But we plan on having no more kids so no one will be carring on his last name, and the bio mom refuses to let us change his last name, even though she remarried, thats a bunch of crap. I had to vent...It drive me nuts that she wont chang his last name, he has her maiden name.

yuo can name your baby whatever you want even make up a NEW last name! doesn't matter as far as paternity or custody or child support.

In Nj My daughter has my last name, Iam her Mom, father and I were not married. Father present at birth and well aware that since we had no plans on marrige that the child would carry my last name. Since you were not married you are not obligated to give the child his last name support or not. Quit frankly it is much easier on the CP and the child that they have the same last name, people are less confused and also the child will have a more secure sense of belonging since you will both carry the same last name much less confusion. Also if you do marry keep this also in mind if you decided to take on the married name maybe keep your maiden name as well so as to not add to confusion.

Your not obligated to name the child the fathers last name, but if it’s a boy and he has no one else to carry on his last name, then morally yes you should, unless the last name will hurt the child “guilt by association”.(if father has a bad reputation that would follow the child).. but if the father is paying support and is a good father, then he should be entitled to the right of the child being named after him... JMO.... but the choice is yours...

I realize Pthalo thats what YOUR plan is. And if the child is yours and if the child carries the husbands name than yes, I think the child should have yours, OR her maiden, or hyphen the two, thats fine and fair.

I don't want to argue moral points. Legally, yes she can name the child whatever she wants but quite frankly the only way I could see dad having a REAL right to go to court, would be if she was going to name the kid mortimer snerd, and NEITHER parent was 'snerd"

our poster never gets into the fact of whether or not dad is agreeable for all we know, he may not care, but they are concerned about legalities. Maybe they will hyphenate, who knows.

In WA state for unwed parents, mother can name baby what ever she chooses, and has up to one year to change the last name without going to court. Check with your local vital statistics office, usually located within the community health district office.
