Dear Dad,

Should you choose to fight your ex over the naming of your child, this is what is likely to happen:

WORST case scenario is that baby will carry a hyphenated name.

BEST case scenario is that baby will carry your last name.

Please understand that Mommy does NOT have the right to arbitrarily change your child's name.

(OP - marriage, dear, confers a LOT of rights to Dad)

I know it's fine... it's going to have to be.

Unfortunate for you, there's probably no one else on this board that posts regulary that knows the CA court system like I do.

However, there are plenty of attorneys you can call and pay for your answers.

P.S.: To Prosperpina - this is a child that practically just got here. The chances are greater that baby's name will be changed outright - not hyphenated. This is CA, we work a little differently here.

We're talking about a - what - 3 or 4 month old baby?

That is correct. A child that doesn't even KNOW his name... and would never know if its name was changed.

I know this sounds cliche, but I know someone who's child's name was changed completely... at 11 years old, in a contested case. No hyphen, no nothing. After the elementary school diploma had already been printed.

we've been most helpful. I think earlier on page 1, I didn't know what I was talking about. :rolleyes: Maybe if she's lucky, someone who sits in a courtroom as much as I do will come along and give her an informed response...

I wouldn't count on it. But hey, stranger things have happened.

Darn, I didn't realize it was so late and I have to get up at 5:00AM :eek: every morning. I have to go to bed but I'll be back tomorrow.

Tell you what. First thing in the morning (because we're not far from morning right now as it is), you just go ahead and call up a local attorney in California (and please wave politely to CC because she does, after all, work in the CA court system) and ask the question.

I expect you will return here and say "Oh gosh you're ALL wrong and goodness gracious me I am going to do what I want and this is a waste of time and by 2pm today my baby's last name will be changed to Flinklegibbet Scrungybunk because that's MY last name!".

Proser, I can't do it tomorrow as I'm teaching summer school to 2nd graders. But, when I meet with my lawyer I'll ask. I'll update when I find out :p I'm sure you'll both be waiting with baited breath, lol.

Now I'm really going to bed. Thirty 2nd graders and feeling tired do not mix well. Ask me how I know. :cool:

Just because I would hate for kids to be taught poor English, that would be *bated* breath. Baited is something you did to a fish hook or a mousetrap.
