Help! Long story short, we have joint custody and our daughter lived w/me until last year. She moved in w/her dad. We had the papers changed, and child support roles reversed. I tried to pay him, he told me he did not need the money, he was saving $ since she moved in. He would give the checks back, said he was fine, we "only had to put the support in the papers" Ha!ha! I started to send cs payments electronically and he has cashed them. Since the news of my upcomming wedding, he has filed contempt papers, saying I am in arrears. He wants back support and legal fees. Court date is set, I have his cs $, can I send it to his lawyer?, do I have to pay his legal fees? Can it be settled out of court? I have no idea what to expect. Any advice would be great!
 


Suggestion

Send a check for the balance of support that is owed (according to the order) to ex. Along with the check, send a polite letter (not accusatory in tone but matter-of-fact) explaining the story that you have detailed here. Send a COPY of both the check and letter to his att'y.

Prepare to have the case dropped. If not, go to court. Tell your story. Explain how this "problem" presented itself only after your impending wedding. Present your copy of the check and letter sent...and any of the original checks that ex refused.

Expect to NOT have to pay any interest or legal fees. Have fun.

okay! After I send that, if it is dropped, will his att'y send me something in writing saying that it has been dropped??? Sorry, no clue how this stuff works.
