Bad Neighbor in HOA.

What is the name of your state (only U.S. law)? Arizona

I share a wall with a person who has 3 dogs in a small space, 2 of them live outside. One of them barks constantly and the police have been called numerous times. They saw there is no regulation to prohibit the barking. So that is one issue.

The second is these people appear to be dirty. They have overgrown foliage which our HOA management company said we can do nothing about. It encroaches on my property. Their yard is filthy with feces and urine and wood ticks. The smell AND the ticks come over here, I suspect riding in on the overgrown foliage. They also leave for days and the 2 dogs are left outside, while one remains inside with no potty breaks.

I have a small old dog and old cat who enjoy their enclosed yard and come back in loaded with ticks. The dog is old and in poor health so the chemicals I have to spray both inside and out are causing his health to decline further. I cannot treat the cat. I have found ticks crawling my inside walls. I myself have a clinical dx of Lyme Disease already so I am terrified of all these ticks, plus I have COPD and the chemicals in my home also make me ill, as well. The HOA management company is not helping. And I am the only neighbor thusly affected since I share the common wall.

What recourse do I have, and with what agency? Thank you for anticipated response.

The health department might help. MIGHT.

You can trim back the foliage that encroaches on your property.

You can protect (and should be protecting) your pets with medicines available from your veterinarian. For example, with one dose once a month of Revolution, both your older cat and your older dog will have protection from ticks, fleas, heartworm, ear mites, worms. This eliminates all of the chemical treatments you have been using in your home.

If your neighbors' pets are being neglected and/or left on their own for two or more days, contact the Humane Society and they will investigate.

Despite the response of the police in the past, I suggest you check your city/township code for a noise ordinance that covers dog barking. Most places have them and I would be very surprised if your area does not. If there is a noise ordinance, and the barking of the dogs is continuous and to the extent that it can legitimately be seen as a nuisance, try calling the police again, pointing out the ordinance when you call.

Continue to monitor your own health and treat your Lyme disease as recommended by your physician.

My dog has the anti-tick stuff on him. The vet said not to put anything on the cat. The deputies are young and don't know the ordinance so we have to look it up for them. Apparently. I have no recourse but to spray my yard and my home, since they come in on my animals and their protection causes the ticks to fall off in my home; it doesn't kill them so I have to spray in here. No choice. My dog is not a barker. Sometimes he will become concerned at the neighbor dog barking because he does not see what the "alert" is and will bark. I tell him no and he stops, so no problem there. I am concerned about being re-infected and this is a valid concern to all suffers of lyme. Pets also get lyme disease and it is devastating. We've called Humane and Health and are waiting for a response.

I gotta ask ? does your city or county have a ord that spells out how many dog poops that are just left in place in a yard earns someone a ticket ? weed control ords ?

Arizona's a dangerous place for people to leave their dogs out in the backyard when they go away for a couple of days. Be a shame if something happened to them.

Sometimes you just need to be patient and let things work out for themselves. Revolution is a good product. I suggest Sinatra and a nice merlot.

right. coyote alley and so happy the little one has not been taken. it's frightened, and scared of the dark. she know my voice now and calms when i speak to her. terrible people to treat an animal like they do. thank you for response
