My husband & I filed BK just three days ago. My question is can I continue to use our bank account as I normally do?
We still have car & house payments ect.. can we as normally deposite our work checks into our bank checking account & then write out checks to pay these bills?
Does the trustee print out or have access to our bank accounts - will I have to explain every check that I have written or any mac withdrawls?
Since our bankruptcy will "hopefully" be discharged before we file for our federal income tax will we get our refund or will that go to the trustee?
I was okay up to the point I actually signed to file & now I'm getting a little scared with this waiting !

I filed Sept. 10 and had my 341 Oct. 4, I have used my account just like I always do. The only advice my lawyer gave me was that the balance in the account should be low on the day of filing. The trustee looks at the day you filed as a snapshot of your finances. I had about $300 in my checking account the day I filed, and had a copy of the statement but did not have to show bank statements to the trustee. I get paid monthly, so shortly after the day of filing there was a large amount in there but I was never questioned about this.

Anything you make, e.g. from wages, after you file the petition does not belong to the bankruptcy estate. If it is interest on investments/assets you have on the day of filing, those proceeds of what in effect is bankruptcy property belongs to the bankruptcy estate.

This is a question that you need to ask your BK attorney about, as my BK7 was handled differently here in Arizona. I had to show 6-months of statements, paychecks, and all bills. Basically to show that I wasn't taking out large sums of money and stashing it. Plus, on the day of filing I was only to have a sum of $150.00 in my bank accounts.
