Bank Mistreatment? ATM Shredded!

Hello,
I live in Maine, and have run a DBA here for 1.5 years. I have a small business account and a Debit/Visa with the account.
This afternoon I went to an ATM at a different bank, one which I am not a member of. I carried on with a $40.00 cash withdrawal session as usual. I agreed to the $1.50 charge, and at that point, instead of giving me $40.00, the ATM printed a receipt and the screen said that my card had been retained. The receipt said the same.
I immediately went into the bank, showed them the receipt, gave them my driver's license, and asked how to retrieve my card. I was told that, since I was not a member and they did not have access to my bank accout, that I would need to go to my bank and have them authorize the return of my card.
Fair enough - I thanked them, and drove a half mile to my bank (who does not have a drive-through ATM, or I would have gone there in the first place).
After 4 different bank employees searched my account information, they could not come up with a reason for my card to be retained. There was nothing wrong with my account and it was fully accessable to me.
Then they contacted the "other" bank to authorize the return of my card...Except, the other bank had destroyed my card.
Destroyed it - in just one hour.
Now, I have to wait 10 business days to receive a new card in the mail from my bank. This is a huge inconvenience, and I am more than disappointed - there was no need for my card to be taken!
Can this happen? Is a bank that I am not even a member of allowed to destroy my business' property with no reason or authorization? Is there anything I can do beyond writing a letter to the branch manager? Should my bank be getting involved?

THEY ARE INVOLVED. THEY ARE ISSUING YOU A NEW CARD WITHIN 10 DAYS.


DRY YOUR EYES. IT MAY BE A SLIGHT INCONVINIENCE BUT DEAL WITH IT. WHAT ARE EXPECTING? SOMEONE TO TELL YOU THAT HAVE A GREAT CASE AND YOU COULD WIN $100K IN COURT.

That is more than likely NOT true. Most banks don't have the ability to just run out to their ATM and open it. They are on an alarm system that has to be opened by the ATM owner and/or service that maintains them.

*** I agree.... but you should be disappointed with YOUR bank!! There is no excuse for them to take days, or even hours to replace your card. I lost one in an ATM one time and my bank simply said 'come on in' and they issued a new one on the spot. I would try talking with your bank again... or consider moving your funds to a 'real' bank.

*** Based on your post, I agree. However, the computer or system 'glitch' is just another 'hiccup' on the road of life. Get over it.

I didn't post to this forum to have you tell me to "Dry my eyes" or to hear "Get over it - that's life" Come on...I have now read about 15 different posts that you have both posted to different people, and your attitudes are simply terrible. A lot of people are posting here, just looking for some friendly advice, some people are very confused, some are angry and some just have simple questions. No one here deserves to have you disregard them in taht manner. Don't reply to posts at all if you're not helping the person asking the question.

All I wanted to know was whether or not the "other" bank had done something wrong.

I certainly did not need to hear from you.

the bank has made a mistake, but you are the one inconvinienced. That's it. The bank will make you a new ATM card and will send it to you when it is ready. There is nothing more that can be done. Were you really expecting to gain finacially out of this or what were you expecting?

I agree with the original poster

in as that I came to this site to seek objective assistance. I did not nor did that individual come to this site to be made out as if we are looking to gain financially from anyone.

A question was asked - Did someone do something wrong? or even Did I do something wrong? No one should automatically assume that the fact that the question was asked that the person was looking to sue. The fact is they are simply looking for an objective out of the situation answer.

Please respond in a curteous manner and respond with the 100% understand that this is just a question being asked.

Read your banking agreement. The ATM card does not belong to you, it belongs to the bank. It is given to you as a convenience to allow you access to your account. Just like your driver's license and credit cards, they are yours but you don't own them, they are owned by the issuing entity.
