What is the name of your state (only U.S. law)? DC
My mortgage company lost my original mortgage and they are asking me to sign a replacement. I've never been late but quite frankly this gives me peace of mind and I don't want a lien on the house if I can avoid it. Am I legally required to sign the replacement?

I would be surprised if the mortgage isn't recorded alongside the deed at the register of deeds in your state.

No, you don't have to sign a new mortgage.

You mean to tell me that you didn't keep copies of your mortgage papers from when you first took out the loan?

Yikes.

Look up your recorded mortgage yourself. Get a copy for your own files. Tell your lender where you found it and suggest they do the same.
