What is the name of your state? Fl.

I am thinking about filing Chapter 7 without a lawyer. My case seems to be straightforward -I have NO assests. I was wondering if the worse would be if the case were dismissed I can then re-file using a lawyer?

my husband and i filed prose and had our creditors meeting today. i can just tell you a bit about our experience. we got the required documents (ch7 petition) and filed it dec. 15, 2004. things went smoothly. we did have a few creditors call us and try to bully us a bit, them wanting their money ect. we kept track of all the violations they made, date, time name of person of all calls ect. we even had some threats from creditors. they can be nasty when they want to. we had our home number changed so we would no longer recieve those calls. we included every debt we could possibly owe in the petition. ours was a no asset case as well. we were even able to claim our 2004 federal tax return as exempt. we went to our creditors meeting today. it went smoothly. we were the only people for the whole day that was not being represented by a lawyer. there was 3 cases in front of us and we were actually the first people up as none of their lawyers had shown up for the meeting. here they had paid a large some of money adn they didnt show up. they asked us about 10 questions, told us it was a no asset case, and to take care of ourselves. our discharge date is in 2months from now. it was pretty straight forward. just thought you might want to know how it went for us, might help you or not. i am a worry wart and worry aobut everything. i am suprised the meeting went so easily. thought it would be really scary. now i can relax a little bit.

How did you fill out your paper work? Any help? Did you research before filing? Did your expenses come out to more or less than your income? Just asking because we are filing pro se, andmy only worry is that we shell out more than we bring in. But we are borrowing from Peter to pay Paul, and dont want it to seem like we undocumented income.

I Used A Bankruptcy Website. I Filled In The Paperwork Myself And Then I Printed It. It Was A Nice Website. I Had No Problems With It. All The Info That I Typed In Was Transferred To All The Required Fields In The Different Schedules. The Only Problem Was That You Only Had So Long To Complete The Work. What I Did Was Save It To My Computer Once I Had Completed It And I Did Have To Make Some Changes Afterwards But I Did Those In Printing And Just Added A Page. The Court Where I Had Filed It Had No Problems With That. I Had Researched The Bankruptcy Laws And Stuff Before Filing. This Website Was A Great Big Help Since I Had A Creditor That Was Violating The Stay And I Got Some Good Advice On How To Handle That Through This Website. My Husband Is In The Army And We Make Ok Money. The Thing Was Is That Our Bills Were Adding Up And I Had A Bad Accident On My Horse In August And The Military Wouldnt Pay The Doctors Bills. Our Expenses Were Higher Than Our Income. When We Went To The 341 Meeting I Was A Little Nervous - My Husband Wasnt As He Faces People Like That All The Time. The Case That We Saw Before Ours A Fella Was Hiding Assets So We Got To See The Bad Side Of The Trustee. Lots Of Questions. When It Came To Our Time To Get Up In Front Of Him He Just Asked A Few Questions. Like If This Was Our Signatures, Did We Include Everything We Wanted To, Had We Ever Filed Ch7 Before Ect. He Said It Was A No Asset Case And Discharge Would Be In 2 Months. We Had No Lawyer, We Were The Only Ones For The Whole Day That Did Not Have One. The Trustee Was Suprised By This But The Funny Thing Was That The 3 People Scheduled Before Us Had Lawyers And None Of Their Lawyers Had Shown Up. They Wasted Between 1200-1500.00 All We Paid Was The Filing Cost. Our Ch7 Was Basically Straight Forward. We Did Have Some Creditors That Kept Calling But I Got Some Good Advice From This Website. If You Do Have A Creditor That Keeps Calling I Told Them That They Were In Violation Of The Automatic Stay And That I Was Taping This Conversation. I Would Then Let The Judge Hear It. I Never Heard From Them Again. If You Have Any More Questions Please Let Me Know. I Also Had Found Out That The Federal Exemptions Were Much Better Than Our State Exemptions. We Were Even Able To Exempt Our 2004 Federal Tax Return.

the website i used was guaranteed bankruptcy services. go to www.guaranteedbankruptcy.com. i had no problem using this website. you only have so much time to fully complete the paperwork. i believe it was like 2-3 weeks. it only took me about an hour to completely finish the paperwork. i saved my forms to the computer and when i had to go in an change some things all i did was do it in pen. our bankruptcy court didnt have a problem with that. i had to make a few changes to it before i filed.
